General Conditions of Sale and Use (GCSU) before using our website. By using any part of this website, you agree to be bound by these Terms and Conditions. If you do not agree to all of the terms and conditions of this agreement, then you must not access the website or use any of the services offered on it.
The General Terms and Conditions of Sale are concluded on the present website www.kactus-klothing.com, administered, managed and published by the limited liability company KACTUS, whose registered office is located at 341 Rte de Saint Jean de Bournay, 38440 Villeneuve de Marc, FRANCE.

Our shop is hosted by ‘Shopify’, they provide us with the e-commerce platform that allows us to sell our products and services to you.
PURPOSE
The purpose of these conditions is to define the terms of use, ordering, payment and delivery between the www.kactus-klothing.com website and the customer.
PRODUCTS
All products for sale on www.kactus-klothing.com are offered while stocks last. The products available on the site are described and presented as accurately as possible. However, KACTUS shall not be held liable for any errors or omissions in this presentation.
Photographs of the products offered may be subject to minor alterations (colours, sizes, shapes).
ORDERING
Customers may select items from our catalogue and place them in their ‘Basket’. By clicking on the ‘Payment’ button, the customer completes the order for the products in the basket. They will then be asked to provide their personal details (including payment details). Before finalising an order, customers can view and modify the details of their order at any time. Confirmation of an order constitutes acceptance of our GTCU. If the customer does not agree with these terms, it will not be possible to order products on the website.
Placing an order constitutes a sales contract between the customer and KACTUS, subject to the availability of the products ordered.
A confirmation email will be sent to the customer confirming receipt and details of the order.
RIGHT OF WITHDRAWAL
In accordance with article L.121-20 of the French Consumer Code, all consumers have a period of 14 days in which to exercise their right of withdrawal without having to justify their decision or pay any penalties, with the exception of return costs. This period is extended to the next working day if it expires on a Saturday, Sunday or public holiday.

Products must be returned in their original packaging and condition with the order number.
LIABILITY
The limited liability company KACTUS shall not be liable for any loss or damage that your purchases may suffer if such loss or damage is the result of force majeure (natural disasters, pandemics, etc., to be declared by your place of residence), if it is attributable to the unforeseeable act of a third party, or if it is attributable to you.
If the customer's address is incorrect, KACTUS cannot be held responsible for the loss of the order.
PRICES
Product prices are displayed and invoiced in euros. For orders to countries outside the European Union, the customer may be asked to pay customs duties upon delivery.
PAYMENTS AND SECURE PERSONAL INFORMATION
Payment is due immediately when the order is placed, and is made by credit card either via the secure system offered by the payment service provider PayPal (Europe) SARL & Cie, or via the secure system set up by Shopify Payments.
The information transmitted is encrypted and cannot be read during transport over the network. Once payment has been initiated by the customer, the transaction is immediately debited after verification of the information.
In accordance with article L. 132-2 of the French Monetary and Financial Code, the commitment to pay given by card is irrevocable.
By providing his/her bank details at the time of the sale, the customer authorises the seller to debit his/her card for the amount relating to the price indicated. The customer also confirms that he/she is the legal holder of the card to be debited and that he/she is legally entitled to use it.
We have no access to your bank card identifier and number. All transactions are secured using SSL encryption, which guarantees both the identity of the payment organisation and the confidentiality of the data.
We cannot accept payments in instalments.
The personal information provided when placing an order is kept and used solely by KACTUS to ensure the smooth running of our services.
INTELLECTUAL PROPERTY RIGHTS
All elements of the website, including the underlying technology, are protected by copyright, trademarks and patents. Likewise, the trademarks, logos, designs and models appearing on the website are the exclusive property of the limited liability company KACTUS. Their unauthorised use is therefore prohibited and may result in infringement and penalties.
